BY-LAWS WEDSWORTH MEMORIAL LIBRARY

ARTICLE I – PURPOSE

The Wedsworth Memorial Library Board shall have general charge of the Library and the appointment of a Library Director/Librarian capable of administering the Library.  The Augustus Wedsworth Library and Gymnasium Fund has general charge of the library building, light, heat and janitorial service.

ARTICLE II – OFFICERS

Section 1.  The officers shall be chairman, and vice chairman elected annually at the May meeting of the Board after new members are appointed. Annually thereafter, there must be appointed before July 1 of each year, in the same manner as the original appointments for a 5-year term, a trustee to take the place of the retiring trustee. The elected officers shall take office on July 1st following the election. The librarian shall serve as secretary.

Section 2.  Officers shall serve terms of one year beginning July 1st.  Vacancies occurring in any office shall be filled at the next regular meeting of the Board.

Section 3.  The chairman shall preside at all meetings of the Board, authorize calls for special meetings, appoint all committees, execute all documents authorized by the Board, serve as ex-officio voting member of all committees, ensure that a true and accurate record is maintained of all meetings of the Board, and perform all other duties associated with that office.

Section 4.  The vice-chairman in the event of the absence of the chair shall assume and perform the duties and functions of the chair.

Section 5.  The secretary shall keep a true and accurate record of all proceedings of the board meetings and present all bills and financial statements to the Board.  The secretary shall require signatures of two trustees on all invoices before they are submitted to the Town of Cascade clerk.

ARTICLE III – BOARD

Section 1.  The governing body of Wedsworth Memorial Library is composed of five members. Two members will be appointed by the Board of Cascade County Commissioners and two members shall be appointed by the Mayor and the Cascade Town Council. The Mayor of Cascade or Designee is the fifth member. The Mayor or the Mayor’s Designee must be a member of the Wedsworth Memorial Trust. Library Director also attends all meetings of the Wedsworth Memorial Library board.

Section 2.  The term of office of the Board Members shall be five years.  No Board member shall serve more than two consecutive five year terms.

Section 3.  If a Board member becomes unable to serve, the secretary of the Board shall be notified. When any Board member fails to attend three consecutive meetings of the board without legitimate reason, the Board may declare his/her position vacant.

ARTICLE IV – COMMITTEES

Section 1.  Special committees for the study and investigation of special problems may be appointed by the chairman, such committees to serve until the completion of the work for which they were appointed.

ARTICLE V – MEETINGS

Section 1.  Regular meetings shall be held the third Tuesday of January, March, May, June, September & November at 5:30 P. M. in the Meeting Room of the Wedsworth Memorial Library.

Section 2.  The meeting designated for the purpose of the election of officers shall be held at the time of the regular meeting in May of each year.

Section 3.  A quorum for the transaction of business shall consist of a majority of members of the Board. All Board members have voting privileges.

Section 4.  The order of business for regular meetings shall include, but not be limited to, the following items;

  1. Call to Order
  2. Disposition of minutes of previous meeting
  3. Financial report; action of financial obligations
  4. Public Discussion with the Board
  5. Reports of Committees
  6. Librarian’s Report
  7. Communications
  8. Unfinished business
  9. New business
  10. Adjournment

ARTICLE VI – LIBRARIAN

The librarian shall be the administrative officer of the library, shall attend all meetings of the Board and its committees unless excused by the Board or the committee, and under these By-laws and the Board’s declared policies and duties, shall have general charge of the library.  The librarian shall be responsible to the Board for the proper management of the library, for preservation and care of its property, for the development and use of the library’s resources, for the discipline and efficiency of its staff, for efficiency of service to the public and for preparing an annual report covering operation of the library through June 30th each year.  The librarian shall also be secretary of the Library Board.

ARTICLE VI – AMENDMENTS

These by-laws may be amended at any regular meeting of the Board with a quorum present, with the vote of approval of at least three Board members.

ARTICLE VII – PARLIAMENTARY AUTHORITY

Robert’s Rules of Order shall be parliamentary authority on all matters not covered by the by-laws of the Board.

ARTICLE CHECK OUT POLICY

  1. Books may be kept two weeks and may be renewed once for the same period except 7-day books.
  2. DVD’s, audio books, magazines, and VHS tapes may be kept one week and may be renewed once for the same period.
  3. A fine is charged for each day a book, is not returned according to the above rule. No book item will be issued to any person incurring such a fine until it has been paid.
  4. Fines are $.10 a day.
  5. All injuries to books beyond reasonable wear and all losses shall be made good to the satisfaction of the Librarian.
  6. Each borrower shall be responsible for all items drawn on their card and for all fines accruing on the same.
  7. E-Books will be checked out under the policies of the MontanaLibrary2Go system.
  8. New Patrons will be limited in the number of items to be checked out.

Mobile Electronic Devices Lending Policy


Purpose

In fulfilling the Library’s mission to provide access to information and educational resources, Wedsworth Memorial Library lends mobile electronic wireless devices to Library patrons through the “Mobile Electronic Devices Lending” service.

Terms and Conditions

A “hotspot”; 1 iPad or 1 HP Pro (tablet with a keyboard) consists of the mobile electronic wireless device itself, as well as its charger and case. When a patron borrows a mobile electronic device, the patron’s use of the equipment is available under the following terms and conditions. These terms and conditions are in addition to the standard Library policies and other terms and conditions described below for which the user is responsible.

Wi-Fi mobile electronic devices may be borrowed by Wedsworth Memorial Library card holders ages 18 and above with library cards in good standing (i.e. library card is not blocked due to unpaid fines or lost material.  At the time of checkout, the borrowing patron must present his/her library card and state-issued Photo ID. Upon checkout, Library staff will confirm, in the presence of the borrowing patron, that all items are present in the mobile electronic device kit. The patron must sign the Library’s Mobile Electronic Device Agreement before an electronic device can be checked out. Only one (1) hotspot may be borrowed on a patron’s account at any one time, but this can be combined with (1) one IPad OR one (1) HP Pro tablet with keyboard. The loan period for the hotspot, IPad OR HP Pro tablet with keyboard is 14 days with no grace period and no renewals.

The Library will not accept holds on any electronic mobile device.

Overdue electronic mobile devices will be deactivated at closing on the day the device is due. Patrons are not permitted to return the electronic mobile devices to the Library’s book drop. Rather, electronic mobile devices must be returned directly to a Library staff member, who will verify that all components of the electronic mobile device kit are accounted for before checking it in from the borrowing patron’s account. The electronic mobile device kit will not be considered returned until all components of the electronic mobile device kit are returned. Devices returned in the book drop will result in a $10 fine.

By borrowing and initiating use of the Library’s electronic mobile device the user agrees to abide by the Library’s policies and rules, and agrees to hold the Library and its agents harmless from any and all claims, losses, damages, obligations, or liabilities, directly or indirectly, relating to the use of the Library’s electronic mobile device and internet access provided by the Library. Deliberate altering of any files or modifying the configuration of Library-owned equipment is strictly prohibited.

Internet service relies on cell tower technology and coverage. Service outside the continental United States is prohibited; any fees associated with use outside of this area will be the responsibility of the borrower. User experience can vary based on location. The Library is not responsible for personal information shared over the internet or for information or websites accessed. The Library is not responsible for any liability, damages, or expense resulting from the use of the electronic devices.

The borrowing patron will be responsible for lost or damaged electronic mobile devices and accessories (includes theft thereof). Patrons must be mindful of current replacement costs of electronic mobile devices and accessories before borrowing, as he or she will be responsible for paying the actual replacement cost of a damaged or lost electronic mobile device or accessories. The overdue cost for the item is $10.00 per day up to the full cost of the item until replacement device and/or accessories are placed into service for the next borrower.

Any returned device must remain in the library for 24 hours before a patron, or another patron living in the same household, may check it out again. If an electronic mobile device is not returned, the borrower will be charged a $200 replacement cost. If devices are not returned in a timely manner, civil and criminal action will be taken. If the borrower fails to pay the replacement cost for a lost device, they will be banned from the library and legal action will be taken.  Patrons are responsible for the care and or replacement value of all accessories and electronic mobile device checked out, as stated in Electronic Device Agreement.

Electronic mobile device devices must be kept in a temperature-controlled environment (not left in vehicles or in extreme temperatures).

Parents/guardians are responsible for the use of the electronic mobile device by minors.

Unlawful use of the internet or use that violates the Library’s Internet Use and Internet Safety Policies is prohibited and may result in the loss of privileges. The Library prohibits the use of its devices for the display or downloading of pornographic or obscene materials.

Two (2) late returns for any device checkout will result in being permanently banned from borrowing all devices.

Patron Behavior Policy


The Wedsworth Memorial Library wishes to maintain an atmosphere of respect.  It is the responsibility of all patrons and staff to maintain a pleasant, appropriate, and safe library atmosphere.  Wedsworth Memorial Library is intended to be a place where its users can study, do research, browse books, use computers, and generally go about their business in a non-threatening environment.  Patrons are expected to respect the rights of others who require a quiet environment in which to study, compute, research, and write.

No person shall engage in inappropriate/disrespectful behavior on the premises of Wedsworth Memorial Library or when participating in Wedsworth Memorial Library programs.  Inappropriate/disrespectful conduct shall include any individual or group activity that is disruptive to other persons using the library. The Wedsworth Memorial Library Staff reserve the right to determine what is considered disruptive, inappropriate, or disrespectful behavior by patrons in the Library.

Support of Staff Members Actions

The Library Director and other Library staff will support the staff member who has acted on his/her best judgment in dealing with a person.  Any staff member who observes or receives complaints of inappropriate behavior shall:

  • Handle the problem directly with the person.
  • Contact the Library Director if the nature of the situation makes the staff member uncomfortable.
  • Contact the police if the person is not responding to staff requests.

If police are contacted, the Library Director shall be notified as soon as possible

 Incident Reports

Incident reports must be filed in all cases when it was necessary to call for outside help.  A log of incident reports, persons banned and problem persons will be available for staff and police to review.

Hygiene

An individual whose personal hygiene is so offensive as to constitute a nuisance to other individuals, or who is barefooted, or who is without a shirt, shall be required to leave the building.  When the problem is corrected, the individual may re-enter the library.

 Food and Drink

Certain food and drink items are allowed in the library if consumed responsibly.

  • A patron whose food creates a mess or is distracting to others because of the aroma will be asked to eat outside of the library.
  • Drinks are limited to those in closed containers such as covered travel cups, or capped water or soda bottles.
  • NO food or drink is allowed near the computers.
  • Food is limited to snack foods such as cookies and chips or other wrapped items, which are consumed individually

Patrons are expected to clean up after themselves, discard trash in appropriate containers, and notify staff immediately of any spills.

 Disruptive Behavior

Patrons who, by their behavior, persist in harassing or annoying others and thereby disrupt their ability to concentrate on their work will be given one warning regarding the specific behavior.  If the behavior continues, disruptive patrons will be asked to leave the Library for a length of time to be determined by the Library Director.  The minor inappropriate/disrespectful behaviors listed below are prohibited in the Library.  Persons who violate one of these policies, or who exhibit similarly disruptive behavior, shall receive a verbal warning and/or an order to leave the Library for the remainder of the day.  A person who commits multiple and/or serial violations of one or more of these policies, shall be prohibited from entering the Library or otherwise using its services for a period of time to be determined by the Library Director.

Minor Inappropriate/Disrespectful Conduct

Behavior that is considered disruptive to the normal use of the Library may be similar but not limited to the following:

  • Loud outburst of speech, laughter or talking either to oneself or others.
  • Excessive and disruptive conversation or noise.
  • Belligerent or threatening behavior towards staff or other library users
  • Following another person around the Library.
  • Playing of audio equipment without headphones, including the Library’s computers (other patrons should not be able to hear these devices).
  • Carrying firearms or other weapons of any type (except by law enforcement officers).
  • Being under the influence of alcohol/illegal drugs, or selling, using, or possessing alcohol/illegal drugs.
  • Montana Code Annotated 45-8-201. Obscenity.
  • Users who are without a shirt shall be required to leave the building for the remainder of the day.
  • Tampering with arrangement of library materials that makes finding or using them difficult or impossible for all practical purposes.
  • Sleeping in the Library.
  • Monopolizing unreasonable numbers of library materials.
  • Soliciting without the Director’s or Library Staff Member’s permission.
  • Violating Computer or Internet policies.
  • Chasing, running, throwing things and noisily playing.  Parents or chaperones of children who violate this policy will receive the same warnings and penalties as the children.
  • Using Library Computers for longer than the permitted time period.
  • Using another person’s library card.
  • Blocking aisles or walkways with personal belongings.
  • Eating or drinking near the public computers.
  • Littering.
  • Abusive, indecent, profane, or drunken conversation and/or behavior.
  • Knowingly entering non-public areas.
  • Loud playing of audio equipment with or without headphones, including the library’s computers (Other patrons or staff should not be able to hear these devices).
  • Any other offensive/disrespectful behavior

Major Inappropriate/Disrespectful Conduct

The following major inappropriate/disrespectful behaviors are prohibited in the Library.  Persons who violate any of these policies, or who exhibit similarly disruptive behavior shall be prohibited from entering the Library or otherwise using its services for a period of time to be determined by the Library Director.

  • Attempted theft, damage or mutilation of library materials or facilities.
  • Smoking or using tobacco products in any part of the library.  Smoking, including electronic cigarettes or any other type of smoking device, is not permitted in the library or within 20 feet of an outside door.
  • Intoxication or incapacitation by drugs or alcohol which creates a risk to the person in question or to others.
  • Taunting, stalking, following, challenging or provoking another individual.
  • Using abusive, threatening or menacing language or gestures.
  • Hindering, impeding or preventing the movement of an individual into, out of, or around a Library facility or vehicle.
  • Refusing to leave the Library when directed to do so, or at closing.
  • Any other major offensive/disrespectful behavior.

Other Activities Not Allowed

  • All wheeled devices (such as; bicycles, shopping carts, handcarts, wagons), except strollers and those required by the disabled, shall be left outside and may not obstruct traffic entering or exiting the building.
  • Climbing on furniture.
  • Bathing, hair washing, shaving, or making a mess is not permitted in the restrooms.
  • Indecent exposure, public lewdness, and voyeurism is prohibited.
  • Panhandling

 Criminal or Dangerous Behavior

All criminal and dangerous behaviors are prohibited in the Library.  A person who commits a crime in the Library or violates any of the following policies shall be prohibited permanently from entering the Library or otherwise using its services, upon penalty of a charge of criminal trespass, and the Library may file criminal charges against the person.

  • Threatening to attack or physically attacking another person is prohibited.
  • Indecent exposure, public lewdness, and voyeurism are prohibited.
  • Child abuse is prohibited.  Library Staff are mandatory reporters.
  • Intentional destruction of library materials, furnishings, equipment, building, or vehicle, is prohibited.
  • Theft of Library, staff or another person’s property is prohibited.
  • Making bomb threats against Library property or from Library property is prohibited.

Specific Library Rules

Unattended Minors:

  • Children seven years old and under must be accompanied by an older, responsible person. The child’s parent or caregiver, if known, will be contacted if the child is left unattended. The library staff reserves the right to turn over to proper authorities, any child, seven years old or younger left unattended or left after hours. Under no circumstances is a staff member to give any Library patron a ride during working hours.

Failure to follow the above policy regarding behavior and food may result in temporary expulsion from the Library and suspension of Library privileges.  Continued disregard for the policy may result in permanent expulsion.  Library Staff has the final authority in determining what constitutes disruptive behavior.  Library Staff will document violations of the Patron Behavior Policy.

Banning Procedure

After staff consultation regarding behavioral problems, and it is determined a person should be banned for more than a week, the Library Director will provide written decision setting forth the period during which the person shall be banned and specify the reasons.  The person will receive a copy and this document will be kept on file.

A Library user may appeal a penalty, to the Library Director, in writing within seven business days of notification of a penalty.  The Library Director shall uphold or overturn the penalty within seven business days of the receipt of the appeal.  The penalty shall be enforced until the Library Director has decided on the appeal.

A Library user may make a final appeal of a decision by the Library Director upholding a penalty, to the Library Board, in writing, within seven business days of notification of the upholding of the penalty by the Library Director.  The Library Board shall uphold or overturn the penalty within seven business days of receipt of the final appeal.  The penalty will be enforced unless and until the Library Board overturns the penalty.  The decision of the Library Board is final.

Penalties for Violating Rules*

First Violation: Verbal Warning

Second Violation: Prohibited from Library for 30 days

Third Violation: Prohibited from Library for 6 months

Fourth Violation: Permanent ban (expulsion) from Library

*Wedsworth Memorial Public Library reserves the right to ask a patron to leave the premises without prior warning, depending on the seriousness of the violation.

First Violation—Verbal Warning

A library user/patron who violates the “Patron Behavior Policy” shall receive a verbal warning on the first offense, unless the offense involves the commission of a crime, threat to another person, or significant damage to property of the Library or another person, or other serious offense, in which the Library Staff will call the Sheriff’s Department.

Second Violation—No Admittance, 30 days

A library user/patron who has previously received a verbal warning for violating the “Patron Behavior Policy” but commits a second violation, shall be prohibited from entering the Library or otherwise using its services for a period of 30 days upon penalty of a charge of criminal trespass, unless the offense involves the commission of a crime, threat to another person, or significant damage to property of the Library or another person, or other serious offense, in which case, the Library Staff will call the Sheriff’s Department.  Patron will be notified of the penalty by mail.

Third Violation—No admittance, 6 months

Upon commission of a third violation of the “Patron Behavior Policy,” a library user shall be prohibited from entering the Library or otherwise using its services for a period of 6 months, upon penalty of a charge of criminal trespass, unless the offense involves the commission of a crime, threat to another person, or significant damage to property of the Library or another person, or other serious offense, in which case the Library Staff will call the Sheriff’s Department.  Patron will be notified of the penalty by mail.

Exceptions to Penalties for Violating Rules:

All criminal and dangerous behaviors are prohibited in the Library.

 A person who commits a crime in the Library or violates any of the following rules shall be prohibited permanently from entering the Library or otherwise using its services, upon penalty of a charge of criminal trespass, and the Library may file criminal charges against the person.

  1. Threatening to attack or physically attacking another person is prohibited.
  2. Indecent exposure, public lewdness, and voyeurism is prohibited.
  3. Child abuse is prohibited.
  4. Intentional destruction of library materials or of furnishings or equipment, or of a building or vehicle is prohibited.
  5. Theft of Library, staff or another person’s property is prohibited.
  6. Making bomb threats against Library property or from Library property is prohibited.
  7. Aiming or discharging a firearm within the Library is prohibited.
  8. Brandishing a weapon within the Library is prohibited.

A library user who has been prohibited from entering the Library shall have all privileges, including remote access to online resources, revoked for a period of time equal to the length of time he/she is prohibited from entering the Library.

 Reinstatement of Library Privileges

Patrons who have been permanently banned from the Library may request a re-evaluation of the banning and reinstatement of the library privileges.

Code of Conduct Related to Banning

Requests for reinstatement of privileges lost due to behavior in conflict with the Disruptive Behavior section must be submitted in writing to the Library Director.  Requests should include a statement demonstrating an understanding of why the behavior that resulted in the loss of privileges is unacceptable in Library facilities and an affirmation that the patron is aware of and understands the expectations for appropriate behavior within the Library.

Factors to be considered during the evaluation of the reinstatement request include the details of the incident that led to the banning, the length of time since the banning, the status of the patron’s Library account, completion of any requirements imposed by the Court as a result of the incident that resulted in the banning and any other information that would attest to the fact that remediation of the behavior that led to the banning has been achieved.

Decision and Appeal Authority

The Library Director will make decisions about reinstatement of privileges in all cases except those based upon threats or physical harm to another person, possession of a weapon, or criminal behavior within the Library.  Decisions of the Director may be appealed to the Wedsworth Memorial Library Board within 7 days of the Library Director’s decision on reinstatement of privileges.

Decisions to reinstate privileges of patrons banned for possession of a weapon within the Library or because of threats or physical harm to another person will be made by the Wedsworth Memorial Library Board of Directors.

The Wedsworth Memorial Public Library uses the following criteria when determining whether to grant an appeal or the reinstatement of Library privileges:

  1. The safety of the public and Library Staff and the circumstances surrounding the exclusion.
  2. The past behavior of the person making the application with regard to the Patron Behavior Policy.
  3. The person’s reasons for appealing his/her exclusion or seeking reinstatement, as well as other mitigation factors
  4. Where applicable, whether the person has reimbursed the Library for all expenses incurred as a result of the person’s actions.

Challenged Materials Policy


Wedsworth Memorial Library believes in freedom of information for all, and does not practice censorship. The selection of library materials is predicated on the patron’s right to read and freedom from censorship by others.  Library materials may be controversial and any given item may offend some person. Selections for the library are made solely on the merits of the material in relation to the development of a collection that serves the needs and interests of a diverse population.

The Wedsworth Memorial Library Board of Trustees recognizes that a collection of diverse materials may result in some complaints or requests for reconsideration. Wedsworth Memorial Library ‘s Collection Development Policy guides the development and continuous evaluation of the collection to reflect Wedsworth Memorial Library’s mission to provide access to resources and opportunities that impact individual lives and build community.

The library holds the choice of reading and viewing materials as a purely individual matter. Patrons are free to reject books and other materials of which they do not approve. Patrons may not exercise censorship to restrict the freedom of others.

Parents or legal guardians are responsible for materials selected and read, heard or viewed by children and adolescents. Library selection decisions are not influenced by the possibility that materials may be accessible to minors.

The Library does not indicate through the use of labels or other devices particular points of view or perspectives contained in library materials.

No items are sequestered to control access.

A formal process for handling challenges will be followed to assure that challenges are handled in an attentive and consistent manner. Those who challenge material must complete a Request for Reconsideration of Library Material

LIBRARY MATERIALS SELECTION POLICY


The selection policy of the Wedsworth Memorial Library is based on the library’s objective and functions, and sets forth principles and standards for building a collection of books and other materials.

AUTHORITY

Final authority for the determination of policy in the selection and acquisition of materials is vested in the Library’s Board of Trustees.

RESPONSIBILITY

Ultimate responsibility for library materials selection, as for all library activity, rests in the Director, who operates within the framework of policies determined by the Board of Trustees.  It is considered desirable to insure the maximum participation of staff members and trustees in the reviewing process.

COMMUNITY ANALYSIS

Formulation of library materials selection policies necessarily begins with the examination of the community of the organizations and the existing collections of the library and of the services which the library is expected to perform.  Flexibility and constant awareness of the changing needs of many different kinds of people the library serves are essential in library material selection.

OBJECTIVES

The library materials selection policy is intended to implement the general objectives of the public library.  The purpose of the selection process is to obtain expertly selected books and other materials to further the library program of giving information, reference assistance, and help to those engaged in educational pursuits, as well as to provide general home reading or entertainment.

CRITERIA

In general the library’s policy has been to purchase the best library materials which satisfy the clientele of the library within budget limitations.  The established criteria for all fields are:

  1. Permanent or timely value
  2. Accurate information
  3. Authoritativeness
  4. Clear presentation and readability
  5. Social significance
  6. Presentation of both sides of controversial issues
  7. Balancing of special group interest with general demand
  8. Inclusion of library materials of doubtful lasting value occasionally for their timeliness
  9. Some library materials may be restricted for minors too immature to see them in their proper perspective. Certain general criteria are followed by all selectors:
    • Authors’ reputation and significance as a writer
    • Importance of subject matter to the collection
    • Scarcity of material on the subject
    • Timeliness or permanence of the library materials
    • Appearance of title in special bibliographies or indexes
    • Authoritativeness
    • Reputation and standing of the publisher
    • Price
    • Availability of material elsewhere in area
    • Reviews will be used when possible

CONTROVERSIAL ITEMS

The Wedsworth Memorial Library asserts its right and duty to keep on its shelves a representative selection of library materials on all subjects of interest to its readers and not prohibited by law, including library materials on all sides of controversial questions.  Library materials on any subject, if published by reputable publishers or entertainment companies and sold without restriction in bookstores, stores or online, will be properly admitted to the public library.  The library will not emphasize one subject without regard to the other side.

LIBRARY MATERIAL’S SELECTION AID

Selection will be guided by skilled use of standard library material’s selection tools, such as basic general lists, current general lists, special bibliographies for reference books and particular subject materials, and book and movie reviewing journals.  While book reviews are a major source of information about new books, they are not followed blindly.  Another selection resource will be the local reader, many of whom are well versed in special, technical, and specific knowledge.

The weeding process employed by the library states that weeding is a function of the selection process and will reflect the concerns that the Board of Trustees employs when there is a selection of a book or other library material:  timeliness, condition of the book or material, appropriateness in filling gaps in the collection and authoritativeness.

No one book or library material selection criterion is relied upon exclusively; furthermore, the critical opinions of revisement are checked against each other.  Selection is to be based upon principal rather than personal opinion, reason rather than prejudice, and judgment rather than censorship.

It is not the purpose of the collection to serve as an elementary or high school or college supplementary library, although many of its books and materials may be so used.  It is the responsibility of the city’s school system to apply these curriculum materials.

The Wedsworth Library’s largest and most important field of emphasis is the adult field of informational education because no other public institution exists here which can perform this function adequately.  The library subscribes to the American Library Association’s Bill of Rights.  In administering its policy, the library tries to keep a true balance between its duty to make available honest presentation of both sides of every public question, and its determination not to allow itself to be used as a propaganda agency by the enemies of our form of government.

Wedsworth Memorial Library Meeting Room Policy


Statement of Principle

The Wedsworth Memorial Library shares the vision of the nation’s founders that liberty and learning are inseparable and that a democratic people must have free, open, and equal access to information.  Wedsworth Memorial Library can provide meeting room space for Library – sponsored programs and co-sponsored programs. When not being used by the Library, the room is available for public meetings and programs of an informational, educational, recreational, cultural or civic nature Mondays after 6 p.m.; Tuesday – Friday after 5 p.m. The meeting room is not available on holidays.

Wedsworth Memorial Library subscribes to the principles set forth in the ALA Library Bill of Rights as amended January 23, 1996 which states:

Libraries which make exhibit spaces and meeting rooms available to the public they serve and should make such facilities available on an equitable basis, regardless of the beliefs or affiliations of individuals or groups requesting their use.

Meetings held in the Library are considered public meetings, and open to all wishing to attend subject to fire codes and occupancy load restrictions. Persons wishing to hold a meeting must consult with the Director for their specific requirements.

Denial of Meeting Room Privileges

Organizations not fulfilling their obligations as enumerated in this and other Library policies and procedures may be denied use of the library’s meeting room facilities until such time as these obligations have been met to the Director’s/Library’s Board of Trustees.

Questions and Grievances involving meeting related policies and procedures

Questions and Grievances involving meeting policies and procedures may be directed to the Director or the Board of Trustees. The Library Board shall have the authority to deny a meeting if it is deemed inappropriate to the mission of the Library as advised by the Library Director. Examples of what could be considered inappropriate are:

  • Activities that could be harmful or dangerous to the health and safety of presenters, participants, attendees, library patrons and staff;
  • Activities that might cause harm to the building and/or its contents;
  • Activities that could be harmful to minors, if minors are allowed to participate;
  • Obscene activities as decided by a court of law;
  • Disorderly behaviors or noise levels that could be disruptive to the mission of the library;
  • Illegal activities;
  • Activities that for any reason may interfere with the regular operation of the library;
  • Activities that require too much space or too much security beyond the ability of the library to provide such space or security.

Upon adequate notice and reasons, the Library reserves the right to revoke permission to use any meeting room. Meetings and exhibits do not necessarily reflect the views of the Library Director, Board of Trustees or staff.

Room reservations are made with the following in mind:

  • No selling, solicitation or taking of orders may occur within the meeting rooms. This includes fundraising and donations.
  • The only exceptions are that governmental agencies may schedule a meeting room on a continuing basis only during those periods when Library events are not scheduled, or if the Library co-sponsors an event.

Charges are permitted in the form of a reasonable tuition fee for workshops and seminars. The Library reserves the right to make schedule adjustments according to the following priorities:

  1. Library sponsored and co-sponsored programs.
  2. Local government meetings/programs.
  3. Programs of an educational, cultural, or civic nature prepared for the public.
  4. Workshops/seminars taught through non-profit educational institutions.
  5. Business/organizational meetings of non-profit organizations.
  6. For-profit, private and recreational meetings/programs.

Reservations for the meeting rooms are made in advance through the Director at (406) 468-2848 or in person. The event must be confirmed within seven days or less of making the reservation by completing the Meeting Room Confirmation Form. The Form is available at Wedsworth Memorial Library from the Director.

The following guidelines are applied to the use of the meeting rooms:

  • Children under the age of seven are not to be left unattended in the Library while parents attend meetings.
  • Smoking is not permitted.
  • Alcohol/Drug use is not permitted. Light refreshments may be served.
  • If an event ends after the Library’s regular business hours, the group is responsible for making certain the meeting rooms and restrooms are empty and that the outer doors are secured upon leaving as the staff locks the lobby doors at the end of business hours.
  • Restrooms are available.
  • Please call at least three days in advance to cancel a reservation. If a group does not show up for a scheduled reservation or does not restore the room to a clean and orderly state, the Library reserves the right to with-hold meeting room privileges for at least one month.

Use of the meeting room does not imply endorsement, support, or co-sponsorship by the Wedsworth Memorial Library of the activities that take place in the meeting room or of the beliefs of the groups using the meeting room. Groups or individuals using the meeting room may not imply that the event or program is sponsored, co-sponsored, or endorsed by the Library in any advertising or publicity.

The Meeting Room is suitable for 10 to 15 people with room for eight around a conference table. Chairs and a sink are available.

Scheduling of the Library’s Meeting Rooms – is handled by the Director.  Due to heavy room use, groups are encouraged to make arrangements at least two weeks in advance and to notify us of cancellation.

Reservations – Rooms may be reserved up to three meetings in advance or up to three months in advance. The library reserves the right to limit these reservations so that other groups have access to meeting space. The Library has the first right of use for Library sponsored and co-sponsored programs. The Library may make schedule adjustments according to the Library’s needs and to use the library’s meeting room for library fund raising.

Meeting Hours –A meeting cannot begin before 9:00 a.m. Monday through Friday without the prior approval of the Library Director.

Eligible Meeting Room Users – All meetings and programs will be free and open to the public. Groups using the meeting rooms are not permitted to charge entrance or registration fees or to require the purchase or an item or service as a condition of attending a meeting. Donations may be accepted, but failure to pay cannot deny access to the meeting. Meeting space is available on a first come first served basis, regardless of the beliefs or affiliations of individuals or groups requesting their use.

Clean Up and Damage – Each group is responsible for picking up refuse and leaving the room clean for the next group. Groups will be charged for any damage they cause to the Library, its grounds, furnishings or contents.

Furniture Arrangement – Each group is responsible for its own furniture arrangements in the Meeting Room. Remember to allow sufficient time to arrange the room to your liking. Tables and chairs in the Meeting Room will be rearranged at the end of the meeting. Furniture must be put back as it was found.  Clean up is the responsibility of the group using the library as a meeting room and a charge will be made if additional cleaning is necessary.

Messages – Library staff will not accept calls or relay messages to people attending meetings except in emergencies.

Extra Equipment or Accommodation – If an individual or group requires additional equipment or accommodation, it is incumbent on the person or persons to notify Library staff at the time the reservation is made. Additional equipment includes, but is not limited to, a television, VCR/DVD player, and remotes.

Film/Video Use  – Any group showing films or videotapes will secure all necessary performance licenses and indemnify the library for any failure on the group’s part to do so.

Parking – Parking is available on the street.

Refreshments – are permitted in the room. A sink is available near the Restrooms. Coffee, utensils, coffee pots and refreshments must be provided by the group. Temporary use of the refrigerator/freezer is permitted.

Smoking – is not permitted in the meeting room or anywhere in the building

Storage – The Library does not provide storage for the property of organizations or individuals meeting in the rooms, and does not accept responsibility for materials that are lost or damaged.

Building Security – Organizations using the facility must be particularly sensitive to their library’s need for security. Requesting the exterior door key obligates the individual to sign the Meeting Room Agreement and to pay the installation replacement costs of locks and keys, if lost. The Meeting Room key must be picked up the day prior to the scheduled event and returned on the first day following the event. Return the keys to the Director, or in the book drop next to the Library’s main entrance.

Security and Locking Up – The group or organization using the Meeting Room when the Library is closed will be responsible for assuring that meeting room windows and doors are locked securely after the last of the group has exited. Those using the meeting room are also responsible for checking the rest rooms (as their group leaves the Meeting Room) to ensure the rest rooms are not occupied.

Electronic Access, Safety & Acceptable Use Policy


PURPOSE STATEMENT

The Wedsworth Memorial Public Library provides access to the Internet as one means of fulfilling its mission to develop a materials collection.  The Library endeavors to develop collections, resources, and services which meet the cultural, informational, recreational, and educational needs of our diverse, multicultural communities.

Wedsworth Memorial Library seeks to provide quality Library service to all users in a safe and pleasant environment.  While Wedsworth Memorial Library is sensitive to the concerns of customers about Internet content, no one, including the Library, can control the information available on the Internet.  As an agency of government, the Wedsworth Memorial Public Library cannot monitor, control or impose limits on information accessed electronically.

The Internet contains a wide variety of material and opinions from various points of view.  Not all sources provide information that is accurate, complete or current, and some information may be considered offensive or inappropriate for certain groups.  The library makes no guarantees regarding the quality, authenticity, or accuracy of information accessed online except on the library website at ww.cascademtwedsworthlibrary.wordpress.com.  There is sexually explicit material and other possibly controversial information on the Internet.  Each individual is responsible for his or her own appropriate use of the internet in a public place. The Library does not censor materials or protect library patrons from Internet-based information.

All Internet resources accessible through the Library are provided equally to all library users.  Parents or legal guardians, not the Library or its staff, are responsible for the Internet information selected and/or used by their minor children (under the age of eighteen (18) MCA 41-1-101).  Parents or legal guardians – and only parents or legal guardians– may restrict their minor children – and only their minor children – from Internet resources accessible through the Library.  Parents who believe that their children cannot responsibly use the Library’s Internet access are requested to monitor their children’s Internet use.

RULES OF CONDUCT

Library users are expected to act in accord with Wedsworth Memorial Library guidelines based on common sense, decency, and civility applied to the networked computing environment.  Internet computers will not be used by anyone, including minors, for illegal activity, to access illegal materials, or to access materials that by local community standards would be deemed obscene.

Reservations may be made for computer use.  Reserved times begin and end on the hour and /or half hour.  A patron may use the computer stations if they are available after checking at the desk.  Library staff is able to offer minimal assistance.

Library users are prohibited from: violating copyright law (Title 17, U.S.C.), theft, file theft, modifying files without authorization, altering data, introducing viruses or any other type of harmful or damaging programs, damaging files, making any attempt to gain unauthorized access to restricted files or networks, damaging or modifying computer equipment or software, maliciously disrupting network services, penetration of or attempting to bypass any of the security on the library computers or systems, reselling bandwidth, or any other illegal acts promulgated from or targeting the Library’s computers or computer systems.  No one is authorized to install any program on any of the library’s computer.  This includes any messenger program.  If a program is installed, the party who installed it will be responsible for the cost of the technician to remove the program from the computer at the cost of $125.00 per hour.

Library users are prohibited from:  violating others’ privacy, deliberately crashing or disabling Library or others’ workstations or computer systems, interfering with the work of other users, harassing or intimidating others, concealing or misrepresenting their name or affiliation to mask irresponsible or offensive behavior, sending abusive or patently offensive or unwanted material to others.

These activities are prohibited on devices and systems on the Library’s local area, wide area, and wireless networks, web sites, or other computer or network resources managed by the library.  Any patron owned device that is connected to the library’s networks or systems must also abide by this policy.  Patrons are not allowed to save anything on the C-Drive.  Patrons may save to a flash drive. If abuse of computer systems occurs, those responsible for such abuse will be held legally accountable.

Misuse of Library computer or network resources may constitute trespass or disruptive behavior, both of which carry legal consequences under Montana State Law.  If any device owned by a patron is discovered to be in violation of this policy, the patron and the patron’s offending device will be denied access to the library’s network.

U.S. Copyright law prohibits copying or distributing electronic materials (including music, electronic mail, text, images, programs, or data) without the explicit permission of the copyright holder.  Any responsibility for any consequences of copyright infringement lies with the uses; the Wedsworth Memorial Library explicitly disclaims any liability or responsibility resulting from such use.

By use of the Library’s systems the user agrees that the Library will assume no liability for any loss or damage to the user’s data and hardware, user’s disks or computers, for any loss of data or for any other liability for damage, injury, or consequence arising from the Library’s provision of these services or arising there from. Users indemnify and hold harmless Wedsworth Memorial Library, the Town of Cascade and Cascade County against any liability for damage or loss arising from use or misuse of the services provided by or through the Library.  The library staff must scan software before using the library’s computers.

The library does not offer electronic mail accounts.  Patrons may use e-mail only if you have an e-mail account accessible via the web.

The internet stations are to be used for internet access only.  Patrons may not alter or attach equipment to the library’s hardware.  Users should be aware of dangers of using email, chat, and other forms of direct communication.  Inappropriate use of these is unacceptable.  Giving out patron personal identification information is prohibited.

The Library reserves the right to terminate an Internet session that disrupts library services or that involves user behavior that violates the Library’s policies. Access sessions will be limited to one half hour (30 minutes), unless otherwise authorized by the Librarian in charge.  By mutual agreement, two persons may share one access session as long as their behavior or conversation does not disturb other users or library staff.  Patrons should close all of their sites upon leaving.

Charges for printing or other authorized fees are to be paid by the user at the time of service.

PROCEDURES

Absolutely no food or drink is allowed at the computer stations.  The Library staff will develop rules and procedures as are necessary to ensure the fair and reasonable use of Internet policies.

RESPONSE TO VIOLATIONS

The user’s access to the Library’s computer network and Internet is a privilege, not a right.  Failure to comply with this policy and its procedures will result in the forfeiture of the user’s right to access these computers.

Patron Registration


Application for a library card

  1. The card is for use by this patron only.
  2. It is the responsibility of the library patron to keep a current name, address, telephone number and email address registered with the library.
  3. There is no charge for an initial library card registration or an address change. $1.00 will be charged to replace lost cards.
  4. Cards with no activity in 3 years will be removed from the system.
  5. Persons under age 15 may receive a library card by having the application signed by a parent or legal guardian.
  6. New Patrons must submit physical verification of physical address. Proof of address in Cascade County (driver’s license, utility bill, deposit slip, etc. or postmarked envelope that shows applicant/parent/legal guardian’s current address.)
  7. New Patrons must submit a copy of a driver’s license or government or other picture ID.
  8. Patrons under 15 must have application signed by a parent or legal guardian and include documentation of parent/parents’ or legal guardian’s physical verification of physical address and a copy of a driver’s license or government ID.
  9. New patrons must submit a personal working phone number and a working phone number of place/places of employment.
  10. I will notify the library of any address/email changes and/or the loss of my library card. I understand that the abuse of library rules may result in the loss of my library privileges and patron can be charged with theft if items are not returned to library.
  11. Obtaining a library card from Wedsworth Memorial Library means that the patron can be charged fines for overdue materials; can have their information sent to a collection bureau for nonreturned library materials; and can be charged with felony theft under
  • Per MT Code Annotated: 22-1-506. Liability for injury to books or failure to return. A person who defaces, tears, or otherwise injures any book or other work or who fails to return any book taken by the person is liable to the state in three times the value of the book if the book is not replaced by a new one or another book of identical title, in good order and condition. A statute of limitations may not ever be effective against the claim of the state under this section.
  • Per federal statutes, any person who shall steal, wrongfully deface, injure, mutilate, tear, or destroy Library materials, or any portion thereof, hall be punished by affine of not more than $2,000 or imprisoned not more than 3 years, or both (18USC 1361; 18USC 2071; and 22D.C. Code 3306).

Individuals with Disabilities, Library Service Policy


Wedsworth Memorial Library recognizes and follows the American Library Association Library Services for People with Disabilities Policy.  The American Library Association recognizes that people with disabilities are a large and neglected minority in the community.  Disabilities cause many personal challenges.

Libraries play a catalytic role in the lives of people with disabilities by facilitating their full participation in society.  Libraries should use strategies based upon the principles of universal design to ensure that library policy, resources and services meet the needs of all people.

For the purposes of this policy, “must” means “mandated by law and/or within ALA’s control” and “should” means “it is strongly recommended that libraries make every effort to…”

Wedsworth Library provides assistance to persons with permanent or temporary disabilities on an individual basis.  Services include but are not limited to: assistance with bibliographic sources; orientation to the Library building; space for studying and taking examinations; online resources and the Internet; access to Montana Library2Go; access to Montana Talking Book Library, and the retrieval of materials from our collection.

In order to provide the most appropriate service to meet specific needs, the Library needs to be informed of the nature of the disability and the resulting special need.

Equipment
The Library has accessible workstations for the Library’s electronic services available throughout the library. Zoom text is available on all workstations.

Physical Access

Wedsworth Library has two power-assisted doors that are open during normal library hours. The main entrance to the library is wheelchair accessible. A handicap ramp is accessible for emergency exit.

Parking
Parking for those with a Disabled Parking Permit is available on Front Street in front of the Library.

Restrooms
Wheelchair accessible rest rooms are available.

Retrieval of Books and Journals or Other Assistance
Individuals with disabilities that make it difficult to retrieve books and journal articles will be provided with assistance.  Library staff will use our best efforts to search and retrieve a reasonable number of items.

Displays/Posters Policy


The Director may grant the privilege of placing exhibits, signs, and displays in the library subject to the following conditions:

No poster, display, exhibit, pamphlet, brochure, leaflet or booklet shall be exhibited or placed in the library for distribution without permission from the Director.

No outside organization or individual shall be permitted to display or exhibit any materials, leaflets, or posters which advocate the election or defeat of a candidate for public office, or which advocate an affirmative or negative vote for or against any proposition, whether political or otherwise.

No outside organization or individual shall be permitted to place any box, receptacle or canister which solicits donations, nor shall any poster or display be permitted which advocates or solicits consideration of any product or item sold by any commercial enterprise.

Posters announcing bazaars or programs sponsored by any local educational, religious or fraternal organizations may be displayed provided there is room for such displays and they are of reasonable size.  Such displays shall be on a first come, first served basis.

The library assumes no responsibility for the preservation, protection or possible damage or theft of any item displayed/exhibited.  All items placed in the library are done so at the owner’s risk.

Inclement Weather Policy

  1. Purpose of Policy

While the Library recognizes its obligation to provide regular hours of service, the safety of the public and the Library staff are of paramount importance. Changes in hours of operation may be necessary due to emergency situations such as prolonged power or water outages or inclement weather.  At times when the weather becomes hazardous to the health and safety of the public and/or library staff, the library will close or take safety precautions.

  1. Library Closures:

There are times prior to opening, especially in winter, when the weather could threaten the safety of the public and library staff and would make reasonably safe travel to the library impossible. At such times, it may be necessary to not open the library in part or in full. Furthermore, there are times during operating hours, especially in winter, when the weather threatens the safety of the public and library staff and would make reasonably safe travel to and from the library impossible. At such times, it may be necessary to close the library early. The decision to close or postpone the opening of the library due to inclement weather is at the discretion of the Library Director or his/her chosen substitute.

III. Library Safety Measures Due to Inclement Weather:

There are times when the weather becomes dangerous while the library is open. At times, this may require closing the library so staff and the public can get home safely. Library closures are at the discretion of the Library Director or his/her chosen substitute.

  1. Staff Compensation Related to Inclement Weather Situations:

If the library closes, or if an employee is unable to reach or remain at the library because of inclement weather, he/she may utilize available vacation leave, personal days, or comp time in lieu of time missed on that day. Employees may otherwise choose to make up missed hours caused by inclement weather during that week.

DEED OF GIFT


Many valuable books are received by the Library as gifts, also much useless material.  It is the Wedsworth Memorial Library’s policy to accept all gifts such as books, magazines, pamphlets, DVDs, etc. with the understanding that the Librarian and the Board of Trustees use their discretion as to their use and disposal.

If the decision is made that your gift material will not be added to the Library’s collection and you would like it returned, please fill in the information below.

I (we) irrevocably and unconditionally give, transfer, and assign to Archives and Special Collections, Wedsworth Memorial Library (hereinafter “Archives”) by way of gift the items described as follows:                It is my (our) intent that these materials shall be publicly accessible and available for research in accordance with Archives’ policy.  I understand the materials will be freely open to me (us) as a regular Archives patron. I give consent to the Archives to digitally reformat the materials or migrate existing digital content to new technical environments as appropriate for preservation and/or access purposes.

I (we) affirm that to the best of my (our) knowledge I (we) own or otherwise have unconditional legal authority to make this donation and execute this Deed of Gift regarding the above described items.  I (we) agree that the donated items will become the exclusive and absolute property of the Archives and that they may be managed in a manner consistent with established professional standards of Wedsworth Memorial Library, with no restrictions on their use except as follows: (List any and all restrictions)

The Archives may use its discretion to dispose of material it deems inappropriate for its collections unless I initial here: _________.  With the exception of duplicates, empty binders, folders, covers, picture frames and publications neither by nor about the collection creator (which will be disposed of by the Archives), my initials indicate that documents in the donated materials which the Archives does not want to retain shall be, prior to disposal by the Archives, first offered to me (us) by registered letter. Wedsworth Memorial Library Loan of Equipment/Assets Policy


The following rules govern the use of equipment/assets owned by the Wedsworth Memorial Library.

  • Audio-visual, other equipment and furnishings (as listed below) may be used by the public within the confines of the building free of charge.
    • LCD projector; screens, extension cords; DVD players, televisions; microform readers; flipchart and stand; and other furniture.
    • Computers for word-processing are available for public use at no charge.
    • Public internet access is available at no charge.
    • Supplies associated with the operation of any of the above listed equipment are the responsibility of the user.
    • Borrowers of any of the above-named equipment, furniture, etc., as described in the above policy assume complete responsibility for repair or replacement value due to loss, damage, or theft.
  • Furniture (as listed below) may be used by an approved organization offsite of the library premises.

The Borrower will inform the Library of the loss of the object(s) or of any damage of whatever nature, including any discovered on first receipt/delivery.  The Library reserves the right to recall the object(s) from loan, particularly if the conditions of loan are not being met. The Library reserves the right to refuse to lend to any entity.  Items may be borrowed up to three uses and/or six days in a month. The library reserves the right to limit these reservations so that other groups have access.

The Borrower will provide reasonable access to loaned objects to staff or agents of the Library, for example for inspection or conservation.  The Borrower will not lend the items to any third party, or otherwise remove them from the specified loan venue except in an emergency.

In the event of damage or loss due to negligence by the Borrower or their agents, the Borrower is responsible for the cost of repair, any reduction in the value of the object or full replacement value.

Returning Equipment:  All hardware/equipment/furniture must be returned to the Circulation Desk within 24 hours of the time it was checked out. For example, if the item was borrowed at 8:30 AM on Monday, it is expected that it will be returned by 8:30 AM on Tuesday. If an item is borrowed over a weekend, special arrangements need to be made with the Library Director.
